Buying a Property in Cyprus: Costs, Process & Buyer Protections

Buying property in Cyprus is an important decision, whether you are looking for a permanent home, a holiday residence or a property investment. Understanding the purchase process, legal safeguards, transaction costs and potential risks is essential before making a commitment.

At Touloupis Real Estate Ltd, a registered and licensed Cyprus real estate agency, we combine local market knowledge, commercial judgement and hands-on transaction coordination to help buyers navigate the property market in Paphos and Limassol.

Our approach goes beyond identifying suitable properties. We help clients assess their options, understand relevant commercial considerations, negotiate effectively and coordinate the property side of the transaction alongside independently appointed legal and other professional advisers.

This guide explains the main considerations when purchasing resale, newly built or off-plan residential property in the Republic of Cyprus.

Last reviewed: 20 October 2026

1. Resale, New-Build and Off-Plan Properties

Understanding the type of property being purchased is an important starting point, as the documentation, payment arrangements, applicable taxes and timing of ownership transfer may differ.

Resale properties

A resale property is an existing property offered for sale by its current owner. A separate title deed may already be available for immediate transfer, but this should always be verified.

Buyers should consider the property's physical condition, any alterations, planning or building issues, outstanding charges and possession arrangements.

New-build properties

New-build properties may be completed or approaching completion. Important considerations include the agreed specifications, price inclusions, VAT treatment, construction status, relevant permits and arrangements for issuing separate title deeds.

Off-plan and under-construction properties

Purchasing before construction is completed requires particular attention to the developer's ownership of the land, mortgages and other encumbrances, approved plans, building specifications, payment milestones and expected delivery.

Individual title deeds may be issued later, following completion of the applicable statutory procedures.

These property categories do not, by themselves, determine the legal position or VAT treatment of a transaction.

2. The Property Buying Process in Cyprus

Although each property transaction has its own requirements, the purchase process generally follows six stages.

Step 1 — Establish Your Requirements

The process begins by defining your preferred location, property type, budget, intended use and purchasing timeframe.

A realistic budget should take account of applicable taxes, professional fees, financing requirements and other acquisition expenses.

Step 2 — Identify and Evaluate Properties

Suitable properties should be compared on their location, asking price, condition, specifications, availability and suitability for your objectives.

For resale properties, an independent building inspection may be advisable. For new developments, construction progress, specifications and expected completion should be clarified.

Step 3 — Appoint an Independent Cyprus Lawyer

An independent Cyprus lawyer should be appointed before entering into binding commitments or paying a non-refundable reservation deposit.

The lawyer examines the property's legal position, ownership, registered encumbrances and relevant contractual documentation.

Step 4 — Agree the Commercial Terms

Once a suitable property has been selected, the parties negotiate the purchase price and other commercial terms.

These may include payment arrangements, agreed inclusions, completion dates, possession conditions and outstanding matters requiring clarification.

The independent lawyer reviews the legal and contractual implications.

Appropriate identification and, where required, source-of-funds checks may also form part of the transaction under applicable anti-money-laundering requirements.

Step 5 — Sign and Protect the Sale Contract

Where ownership cannot be transferred immediately, a written Sale Contract is normally signed and deposited with the Department of Lands and Surveys within the applicable statutory period.

Where a separate title deed is available and immediate transfer is possible, the procedure may differ.

The buyer's lawyer determines the appropriate legal arrangements.

Step 6 — Complete the Purchase and Transfer Ownership

The final stage involves settlement of the agreed purchase price, completion of relevant legal and administrative requirements and registration of ownership through the Department of Lands and Surveys.

Payments should be made through appropriate, traceable banking channels, with payment instructions and recipient details independently verified.

Where separate title deeds are not yet available, the lawyer should explain the contractual protection and subsequent ownership-transfer procedure.

3. Legal Due Diligence and Property Verification

Independent legal due diligence is essential to protecting the buyer's legal interests.

Depending on the property, the appointed lawyer should examine:

  • Ownership and title deeds: The registered owner, the property being purchased and the availability of a separate title deed.
  • Mortgages and encumbrances: Existing mortgages, charges, deposited contracts, prohibitions or other registered restrictions.
  • Planning and building documentation: Relevant permits, approved plans and any material differences between authorised and existing construction.
  • Contractual provisions: Purchase price, deposits, payment terms, specifications, completion obligations and remedies for non-performance.
  • Outstanding obligations: Relevant local charges, communal expenses and other liabilities affecting the transaction.
  • Title-transfer arrangements: The required procedures for transferring ownership and addressing any existing encumbrances.

Physical condition, construction quality and other technical matters may require additional examination by an independent surveyor or engineer.

For mortgaged developments, particular attention should be given to the arrangements for releasing the property from existing security.

Touloupis Real Estate coordinates the property-related information and communication with sellers, developers and appointed professionals, while independent specialists remain responsible for legal, technical and other regulated assessments.

4. Title Deeds, Sale Contracts and Buyer Protection

Cyprus operates a registered-title system administered by the Department of Lands and Surveys.

Where a separate title deed is available and the necessary conditions have been satisfied, ownership may be transferred directly to the buyer.

Where immediate transfer is not possible, a signed Sale Contract may be deposited under the Sale of Immovable Property (Specific Performance) Law, 81(I)/2011, as amended.

Land Registry Search Certificate

For Sale Contracts signed on or after 12 December 2023 and falling within the applicable statutory requirements, the seller is obliged to attach a Land Registry Search Certificate as an integral part of the contract.

The certificate must be dated within five working days of the contract date and identify relevant registered encumbrances and prohibitions affecting the property.

Depositing the Sale Contract

The Sale Contract should normally be deposited with the Department of Lands and Surveys within six months of signing.

The current Land Registry fee for depositing the contract is €50.

Timely deposit provides important statutory protection for the purchaser, particularly where ownership transfer is deferred.

However, the deposit does not replace independent legal due diligence or guarantee construction completion or immediate issuance of a separate title deed.

The buyer's lawyer should confirm the requirements applicable to the particular transaction, especially where mortgages or other encumbrances exist.

5. Property Purchase Costs in Cyprus

Understanding the principal taxes and transaction expenses helps buyers establish a realistic acquisition budget.

Value Added Tax (VAT)

The standard VAT rate in Cyprus is 19%.

VAT may apply to newly built properties and other transactions meeting the relevant statutory conditions.

Amendments effective from 1 September 2026 introduced revised criteria concerning the first occupation and systematic use of buildings, including an 18-month use period relevant to the applicable VAT framework.

Consequently, descriptions such as new-build and resale do not, by themselves, determine whether VAT is payable.

A reduced VAT rate of 5% may apply to the qualifying portion of a dwelling acquired or constructed for use as the buyer's main and permanent residence, subject to the applicable statutory requirements.

Eligibility and the VAT treatment of each transaction should be confirmed by an appropriately qualified tax professional.

Land Registry Transfer Fees

Where property transfer fees apply, the standard rates are:

Property value bandStandard rate
First €85,0003%
€85,001–€170,0005%
Amount above €170,0008%

A 50% reduction generally applies to the calculated transfer fees, subject to statutory exceptions.

The Department of Lands and Surveys may assess fees based on its accepted market value rather than solely on the declared purchase price. Ownership shares and other applicable provisions may also affect the final calculation.

Stamp Duty and Transfer Fees — Important Distinction

For property sale contracts drawn up and signed from 1 January 2026 onwards, no stamp duty is payable.

Property transfer fees are not payable where VAT is charged on the same property transaction, subject to the applicable statutory requirements.

Where VAT is not charged, transfer fees generally apply, normally benefiting from the 50% reduction, subject to statutory exceptions.

Buyers should confirm the applicable charges with their independent lawyer before completing the purchase.

The Department of Lands and Surveys Transfer Fee Calculator provides indicative calculations.

Other Acquisition Expenses

Depending on the transaction, additional costs may include independent legal fees, technical inspections, financing expenses and other property-specific charges.

These should be considered when establishing the overall purchasing budget.

6. Can Overseas Buyers Purchase Property in Cyprus?

Cyprus attracts property buyers from across Europe and other international markets.

The applicable legal requirements depend partly on the purchaser's nationality, ownership structure and the type of property being acquired.

EU Citizens

Citizens of EU Member States generally do not require the additional foreign-purchaser permission applicable to third-country nationals.

Non-EU Citizens

Non-EU citizens, including UK nationals, normally require permission under the Acquisition of Immovable Property (Aliens) Law, Cap. 109.

The application, using Form COMM 145, is submitted to the District Administration where the property is located, together with the required supporting documentation.

Under the published administrative framework, permission may generally be considered for:

  • Up to two residential units; or one residence together with a shop of up to 100 m² or an office of up to 250 m².
  • A plot or qualifying land of up to 4,000 m² for construction of an owner-occupied residence.

The relevant limits generally apply collectively to married couples. Companies controlled by non-EU nationals may be subject to additional requirements.

Permission remains subject to the decision of the competent authority and should never be assumed or guaranteed.

The purchaser's independent Cyprus lawyer should confirm the rules applicable to the proposed acquisition.

7. Does Buying Property Provide Cyprus Residence Rights?

Property ownership does not automatically grant immigration permission, tax residence or Permanent Residence in Cyprus.

EU citizens benefit from the applicable European freedom-of-movement framework, subject to relevant registration requirements.

For eligible non-EU nationals, certain qualifying investments may support an application under the accelerated procedure for investor immigration permits.

The published residential-property investment category generally concerns qualifying first-sale houses or apartments purchased from a development company, with a minimum investment of €300,000 plus VAT.

Additional financial, documentary and eligibility requirements apply.

An ordinary resale residence should not be assumed to qualify under that particular residential investment category.

The independent immigration lawyer is responsible for assessing eligibility and handling the relevant application.

No property purchase guarantees approval of a residence or immigration permit.

8. Ongoing Property Ownership Costs

Cyprus has not imposed the former national annual Immovable Property Tax since 2017.

Nevertheless, property owners should allow for ongoing expenses, including:

  • Municipal or community charges and applicable sewerage or water-related charges.
  • Utilities, insurance and routine maintenance.
  • Communal expenses for shared facilities, where applicable.

Properties within managed developments may carry additional costs for lifts, landscaping, swimming pools, security, cleaning and maintenance of common areas.

Buyers should request information about existing or estimated communal charges before purchasing.

Properties intended for rental may also involve tax, reporting and other regulatory obligations requiring independent professional advice.

9. The Touloupis Real Estate Approach: Market Insight, Risk Awareness & Local Execution

Choosing a property requires more than comparing listings and asking prices. Buyers need reliable local knowledge, sound commercial judgement, effective negotiations and professional coordination throughout the transaction.

How We Support Property Buyers

Targeted property search

We begin by understanding the buyer's objectives, preferred areas, budget and timeframe.

This allows us to identify and present properties that genuinely correspond to the client's requirements, rather than simply offering a large number of listings.

Market guidance and commercial assessment

We help clients compare locations, asking prices, property characteristics and relevant market considerations.

Potential commercial concerns are identified early, while matters requiring specialised legal, technical or tax assessment are referred to the appropriate independent professionals.

Viewings and remote presentations

We coordinate physical viewings in Cyprus and remote presentations for buyers based overseas.

Viewing programmes are organised around the client's priorities, with practical follow-up and clear communication.

Negotiations and transaction coordination

Once a property has been selected, we support commercial negotiations and coordinate communication with the seller, owner or developer.

We remain involved in the property-related stages, following up on outstanding matters and helping the relevant parties maintain progress towards completion.

Professional Coordination and Clear Responsibilities

Property transactions often involve lawyers, surveyors, tax advisers, financial institutions and other specialists.

Our role is to coordinate the property side of the transaction, support the exchange of relevant information and help maintain an organised process.

Independent qualified professionals remain responsible for legal due diligence, contractual advice, tax matters, technical assessments and other regulated services.

The agency's role and any applicable remuneration arrangements are clarified as part of the engagement.

For buyers introduced by existing professional advisers, we respect those relationships and coordinate communication according to the client's instructions and confidentiality requirements.

Our objective is to combine knowledgeable property guidance, sound commercial judgement and reliable local execution, helping clients approach Cyprus property transactions with greater clarity and confidence.

Frequently Asked Questions

Is Buying a Resale Property Different from Buying a New Build?

Yes. A resale property may have a separate title deed available for immediate transfer, while newly built and off-plan properties may involve later title issuance, staged payments and developer-related considerations. VAT and transfer-fee treatment may also differ.

Do I Need an Independent Lawyer When Buying Property in Cyprus?

An independent Cyprus lawyer is strongly recommended. The lawyer examines ownership, registered encumbrances, permits, contractual obligations and the legal protections available to the purchaser.

Is VAT Always Payable on New-Build Properties and Never on Resales?

No. VAT treatment depends on the transaction, the property's use and the applicable statutory provisions. The revised rules effective from September 2026 make individual assessment particularly important.

Are Stamp Duty and Property Transfer Fees Payable?

No stamp duty applies to property sale contracts drawn up and signed from 1 January 2026 onwards.

Transfer fees are generally not payable when VAT is charged on the same property transaction. Where VAT is not charged, transfer fees normally apply, subject to the applicable reduction and statutory exceptions.

How Long Do I Have to Deposit a Sale Contract at the Land Registry?

The normal statutory period is six months from signing, where the contract is deposited under the applicable legal framework.

The appointed lawyer should arrange the required procedure within the statutory period.

Can I Begin My Property Search Before Travelling to Cyprus?

Yes. We can begin with an initial online consultation, establish your requirements and prepare suitable properties for remote presentation.

Physical viewings can then be arranged around your planned visit to Cyprus.

Does Buying Property in Cyprus Give Me Residence Rights?

No. Property ownership alone does not grant immigration permission, tax residence or permanent residence.

Certain qualifying investments may support applications under specific immigration schemes, subject to separate statutory conditions and official approval.

How Does Touloupis Real Estate Support an Overseas Buyer?

We handle the Cyprus property side, from the initial consultation and targeted property search to viewings, negotiations and transaction coordination.

We maintain communication throughout the relevant stages and work alongside independently appointed legal and other qualified professional advisers.
